Commission Adopted Successor RA Proceeding

The new rulemaking closes the current RA proceeding, continues the Commission’s oversight of the Resource Adequacy program, considers broader structural reforms to the program, and establishes forward Resource Adequacy procurement obligations applicable to load-serving entities beginning with the 2023 compliance year. A Commission vote is expected to take place October 7.

Highlights from the new OIR include:

  • CCAs are not named as “respondents,” which means that CCAs will not automatically be made parties to the new proceeding.  The filing of initial comments on the OIR or a motion for party status will be required for a CCA to obtain party status.
  • Issues associated with Track 3B.2 (PG&E’s slice-of-day proposal) in the current RA proceeding will be rolled forward into this proceeding and identified as the Reform Track.  As described in the OIR, workshops will continue through January 2022, with an expectation that a workshop report will be filed in February, comments on the report filed in late-February and March, and a proposed decision in Summer 2022.
  • There will be an Implementation Track that will address a variety of standard updates (like local and flex capacity requirements), and will consider new party proposals. (Party proposals will be due in January 2022.)  In addition, the OIR states the expectation that the Commission will be considering (a) “potential modifications to the Central Procurement Entity (CPE) structure and process, including implementation of details of the ‘shown’ resource component of the hybrid framework and changes to the CPE timeline.” and (b) modifications to the Planning Reserve Margin (PRM), including Energy Division’s loss of load expectation study and proposal to be submitted into this proceeding.

  • Opening comments on the OIR are due within 20 days of the issuance of the OIR (presumably by November 1), and parties should identify and prioritize no more than five issues related to RA refinements that should be addressed in the Implementation Track.
