The Commission issued Draft Resolution ("DR") E-5206 approving the Portfolio Sales Agreements ("PSA") from SDG&E to San Diego Clean Power and Clean Energy Alliance. The agreements are for the sale of long-term renewable energy and associated Renewable Energy Credits from various facilities. A vote is scheduled for May 19.
This Resolution approves Portfolio Sales Agreements from San Diego Gas & Electric Company to San Diego Clean Power and Clean Energy Alliance. The agreement resulted from bilateral negotiations, authorized by Decision 21-01-005 and is for the sale of long-term renewable energy and associated Renewable Energy Credits from various facilities. The agreements are approved without modification.
The DR rejects Cal Advocates’ protest to the classification of CEA’s contracts as long-term and find that CEA’s Delivery Period language of “continues until midnight on the last day of the month in which the tenth (10th) anniversary of the Start Date occurs” is sufficiently clear regarding a start and end date to establish the 10-year length, and therefore long-term status of the contract.
The DR also rejects AReM’s protest that the agreements amount to an early implementation of the VAMO and find that the agreements doe not constitute an early implementation of the VAMO and will not impact VAMO allocations once the mechanism is implemented.
