The California Public Utilities Commission passed Resolution E-5143 ("E-5143") which updates rules and penalty amounts for non-compliance with mandatory filing deadlines and reporting requirements of the Renewables Portfolio Standard.
After comments on the draft resolution, Resolution E-5143 expands the RPS Citation Program to include draft and final RPS Procurement Plans ("RPS Plans"), however, deficient draft RPS Plans will not be subject for referral for citation. Although party comments asserted the need for collaboration between Energy Division Staff and retail sellers to meet RPS Plans requirements before being referred for possible citation, E-5143 makes it clear that retail sellers are ultimately responsible for filings.
